Terms of Service

Welcome to Hengout (the "Platform"). The Platform is provided or controlled by Sixnergy ("we", "us", or "our"). Hengout is currently focused on serving users in Vietnam. These Terms of Service ("Terms") govern your access to and use of our applications, products and content (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By registering an account and using our Services, you acknowledge and agree that:

  • You have read, understood, and agree to be bound by these Terms
  • You have the legal capacity and authority to enter into this agreement
  • You will comply with all applicable laws and regulations
  • You are at least 13 years of age, or if under 13, you have obtained parental or guardian consent

2. User-Generated Content

2.1. Your Responsibility

You are solely responsible for all content that you create, upload, share, or transmit through our Services, including but not limited to:

  • Chat messages (text)
  • Activities you create
  • Activity suggestions
  • Vibes and Collections (location storage categories)
  • Group names and avatars
  • Profile pictures and profile information
  • Any other content you create within the Services

2.2. Prohibited Content

You MAY NOT create, upload, share, or transmit any content that falls into the following categories:

a) Objectionable and Inappropriate Content:

  • Pornographic, obscene, or sexually explicit content
  • Violent, threatening, or content that encourages violence
  • Discriminatory content based on race, gender, religion, nationality, or sexual orientation
  • Hateful, inflammatory, or propaganda content

b) Harassment and Bullying:

  • Harassing, threatening, or bullying other users
  • Sending unsolicited messages or spam
  • Collecting or sharing personal information of other users without permission
  • Creating fake accounts or impersonating others

c) Illegal Content:

  • Content that violates copyright, trademark, or intellectual property rights
  • Content that violates privacy rights of others
  • Content related to illegal activities
  • Fraudulent, deceptive, or misleading content

d) Spam and Abuse:

  • Sending spam messages, unauthorized advertisements, or repetitive content
  • Using bots, scripts, or automated tools to create content
  • Manipulating or abusing Platform features

2.3. Automatic Content Filtering

We use automatic content filtering systems to detect and prevent prohibited content. If your content is detected as violating our Terms, it will:

  • Not be sent or displayed
  • Be removed from the Services
  • Be logged for review and action

3. Consequences of Violation

3.1. Enforcement Actions

If you violate these Terms, we reserve the right to take one or more of the following actions, depending on the severity:

a) Warning:

  • Written warning about the violation
  • Requirement to cease the violating behavior

b) Content Removal:

  • Removal of violating content from the Services
  • Removal of all content related to the violation

c) Temporary Suspension:

  • Temporary suspension of your account for a specified period
  • You will not be able to use the Services during this time

d) Permanent Ban:

  • Permanent suspension of your account
  • Deletion of all data and content associated with your account
  • Prohibition from creating new accounts

3.2. Our Discretion

We have the sole discretion to determine what content violates these Terms and what enforcement action is appropriate. Our decisions are final and generally not subject to appeal.

4. Our Rights

4.1. Content Moderation

We have the right, but not the obligation, to:

  • Review, moderate, edit, or remove any content
  • Refuse, restrict, or terminate your access to the Services
  • Delete your account without prior notice in cases of serious violations

4.2. Reporting and Investigation

We have the right to:

  • Investigate reports of violating content
  • Process reports within 24 hours of receipt
  • Cooperate with law enforcement when necessary

5. Reporting Violating Content

5.1. How to Report

If you discover violating content or abusive behavior, you may:

  • Use the "Report" feature within the application
  • Send an email to: sixnergy9@gmail.com
  • Clearly describe the violating content and reason for reporting

5.2. Report Processing

We are committed to:

  • Reviewing all reports seriously
  • Processing reports within 24 hours of receipt
  • Taking appropriate action to address violations

6. Blocking Users

6.1. Block Feature

You have the right to block any user whom you believe is harassing or abusing you. When you block a user:

  • You will not receive messages from that user
  • Content from that user will be hidden from you
  • That user will not be able to view your information

6.2. Managing Blocked Users

You can view and manage your list of blocked users in the Settings section of the application.

7. Age and Eligibility

7.1. Age Requirement

The Services are not directed at children under the age of 13. If you are under 13 years of age, you may only use the Services with the consent of your parent or guardian. If we become aware that personal information has been collected from a person under 13 without parental or guardian consent, we will delete that information and terminate that person's account.

7.2. Parent and Guardian Responsibility

If you are a parent or guardian and discover that your child under 13 has provided personal information to us without your consent, please contact us at sixnergy9@gmail.com.

8. Privacy

Your use of the Services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Location Services

9.1. Use of Location Services

Our Services use your location information to provide location-based features, including:

  • Finding locations near you
  • Creating and managing Collections (location storage categories) based on location
  • Creating and participating in Activities at specific locations
  • Recommending locations suitable for you

9.2. Location Collection Strategy

Our application uses a multi-tier strategy to collect location:

  • GPS (priority): Uses GPS for high accuracy when you have granted permission
  • Network-based location: Uses IP-based location when GPS is unavailable or if you choose not to share GPS location
  • Cached location: Uses previously saved location if needed

9.3. Your Control

You have the right to:

  • Turn GPS functionality on or off on your mobile device
  • Deny location access permissions in device settings
  • Use the Services without sharing GPS location (will use network-based location)

Note: Some features may not work fully if you do not share GPS location.

10. Subscriptions and Payments

10.1. Subscription Plans

We offer subscription plans with different features and limits:

  • Basic Plan: Free plan with basic features
  • Premium Plan: Paid plan with advanced features and higher limits

10.2. Payments

  • Payments are processed through:
    • In-App Purchase (IAP): Direct payment within the application through App Store (iOS)
  • We reserve the right to change payment methods at any time
  • We do not store your full payment card information
  • You are responsible for all charges incurred from using the Services
  • When using In-App Purchase, you agree to the terms and conditions of the App Store

10.3. Duration and Renewal

  • Subscription plans have a fixed duration according to the payment cycle you have chosen
  • Currently, subscription plans do not automatically renew
  • To continue using the Services after your subscription expires, you need to subscribe to a new plan
  • You will not receive a refund for the remaining time of the payment cycle if you stop using the Services

10.4. Changes to Pricing and Features

We reserve the right to:

  • Change the pricing of subscription plans at any time
  • Change the features and limits of subscription plans
  • Discontinue a specific subscription plan

We will notify you of significant changes before they take effect.

11. Third-Party Services

11.1. Social Login

We provide login options through:

  • Google OAuth: Sign in with your Google account
  • Apple Sign In: Sign in with your Apple account

When you use these login services, you agree to the terms and privacy policies of those providers.

11.2. Storage and Processing Services

We use third-party services to operate the Services:

  • Cloudinary: Store and optimize images (profile pictures, group avatars, chat images)
  • App Store: Process payments and transactions through In-App Purchase (IAP)
  • WebSocket: Provide real-time communication features (chat)

11.3. Third-Party Responsibility

We are not responsible for:

  • Services or content provided by third parties
  • Issues arising from the use of third-party services
  • Changes or disruptions in third-party services

You should review the terms and privacy policies of third parties before using those services.

12. Intellectual Property

12.1. Your Rights

You retain ownership of the content you create. However, by using the Services, you grant us the right to:

  • Use, display, and distribute your content within the Services
  • Edit, format, and adjust your content to fit the Services

12.2. Our Rights

All intellectual property rights in the Services, including but not limited to software, design, logos, and trademarks, belong to us or our licensors.

13. Disclaimer

We are not responsible for:

  • Content created or shared by users
  • Behavior of other users
  • Damages arising from use or inability to use the Services
  • Loss of data or information

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through:

  • In-app notifications
  • Email to your registered email address
  • Updating the "Last Updated" date at the top of this document

Your continued use of the Services after changes constitutes acceptance of the new Terms.

15. Termination

15.1. Termination by You

You may terminate your use of the Services at any time by:

  • Deleting your account in the Settings section
  • Ceasing to use the application

15.2. Account Deletion

When you delete your account:

  • All your personal information will be deleted from the Services
  • All content you have created (messages, activities, collections) will be deleted
  • You will lose access to all data and content related to your account
  • We may retain some information in aggregated and anonymized format to comply with legal obligations

Warning: Account deletion is irreversible. Please ensure that you want to delete your account before taking this action.

15.3. Termination by Us

We reserve the right to terminate or suspend your access to the Services without prior notice if:

  • You violate these Terms
  • You violate applicable laws
  • We decide to discontinue the Services

17. Governing Law
